Boulart inc. (also the “Company,” “we” or “us”) is a private company that produces a line of artisanal breads and offers various services, primarily to retailers.

This Privacy Policy informs people concerned with personal information about how we handle that information at every step, from collection to destruction, including use and communication.

In all cases, we undertake to be transparent and to act in compliance with applicable laws, particularly the Act respecting the protection of personal information in the private sector. We undertake to maintain sound management practices with regard to the personal information entrusted to us by applying the appropriate security measures to safeguard it.

Your responsibility

This Privacy Policy is an integral part of the terms of use for the boulart.com website.

It is everyone’s responsibility to read and understand the Privacy Policy and to ensure that they adhere to it and consent to it before sharing their personal information with us using technology.

If you do not agree to adhere to the Privacy Policy, please do not transmit your personal information to us electronically and stop browsing on our website. If required, you can directly contact the Company’s Privacy Officer.

Definitions

In this Privacy Policy, unless the context suggests a different meaning, the following terms have these meanings:

Life cycle: The various stages personal information goes through within the Company: collection, storage, use, communication and, finally, destruction.

Employee: Any person who provides labour, whether full-time or part-time, whether regular, temporary, seasonal or contractual, and whether the person is in a management or non-management position.

Privacy incident: Any breach of confidential personal information, including unauthorized access, use or communication and loss.

Person concerned: Any person whose personal information is collected, stored, used, communicated or destroyed by the Company.

Privacy Officer: The person responsible for the protection of personal information, whether it is the person with the highest authority or another person delegated to this role.

Personal information: Any information, electronic or not, about a person that allows the person to be identified or that confirms their identity, directly or indirectly. Due to its nature (e.g., medical, biometric, financial, etc.) and the context of its use or communication, personal information entails a high level of expectation of privacy for a reasonable person. When the protection is breached in a privacy incident, the risk of serious harm is high.

Third party: Any person or organization other than the Company and its employees.

Privacy Officer

The Privacy Officer is in charge of enforcing the Act respecting the protection of personal information in the private sector and all the practices implemented by the Company, including the Privacy Policy.

The Privacy Officer plans, organizes, directs and controls all aspects related to personal information management practices within the Company, including training, informing and raising the awareness of all employees and managers.

Collection and use of personal information

Our website contains forms, such as the contact form, through which we collect people’s first and last names, addresses and email addresses. Furthermore, to register to conclude a contract, information required for the contract must also be collected using technological means (e.g., banking information).

In all cases, we undertake to collect only the personal information required for a specific purpose, which you will be informed of. We ensure that the personal information we collect is only used for the specific purpose for which it was collected. Before we use your personal information for another purpose, we will ask for explicit consent, except where the law authorizes us to proceed without consent.

All the information collected through your use of the website is stored on servers located in Québec. However, this information may be processed by the Company’s service providers outside of Québec, to allow them to carry out contracts on our behalf.

Destruction of the information

We only keep the personal information we collect for the period of time required to achieve the original goals, subject to a minimum time set by a law or regulation.

When the time comes, the documents containing personal information are completely, permanently and securely destroyed or anonymized in a way that completely, permanently and securely destroys the connection between the information and the identity of the person in question.

Request processing

To exercise your rights, you must submit a written request by sending an email to the Privacy Officer identified in this Privacy Policy and on our website.

The Privacy Officer is responsible for processing all personal information requests. On receipt of your request, the Privacy Officer will ask you to prove your identity and may assist you in doing so. A response will be sent to you within 30 days of our receipt of your complete written request.

If your right of access or correction is refused, the Privacy Officer will provide you with the following information:

  • The legal provision supporting the refusal
  • The recourse offered to you under the law
  • The deadline for exercising your recourse

At your request, the Privacy Officer will help you understand the grounds for refusal.

Access to and correction of your personal information are free. However, a reasonable fee may be charged for the transcription, reproduction or transmission of that information. In this case, you will be informed in advance of the approximate amount of the fee.

Filing a complaint

We are open to receiving any complaint, which the Privacy Officer will process diligently and within a reasonable time.

Your name and contact information will be required so we can contact you. When you file a complaint, please explain the reasons in sufficient detail for us to process it effectively.

We take all complaints brought to our attention seriously and we undertake to consider the points raised with a view to continuous improvement.

Effective date and updates

We reserve the right to amend the Privacy Policy at any time. In the event of an update, the date will be changed and the new version will be posted on our website.
